Decapitated Vocalist & Bassist Formally Charged With Rape & Kidnapping & Plan To Pursue Bail

Decapitated singer Rafal Piotrowski and bassist Hubert Wiecek had their first court appearance in Spokane County on Friday for allegedly participating in a gang rape of a woman on their tour bus in Spokane on Aug. 31. With the aid of a Polish translator, Judge John Cooney communicated the charges of first-degree kidnapping and second-degree rape to Piotrowski and first-degree kidnapping and third-degree rape to Wiecek.

Waclaw Kieltyka and Michal Lysejko, the band’s bassist and drummer, had their first court appearance in Spokane on Oct. 13. Kieltyka was charged with first-degree kidnapping and second-degree rape and Lysejko was charged with first-degree kidnapping and third-degree rape.

All four band members had their bonds set at $100,000. They also aren’t allowed to talk to each other while incarcerated and were forced to surrender their passports to their attorneys.

The band has been in Spokane County Jail after being extradited from California. They were arrested Sept. 9 in Santa Ana in connection with the case and charged on Oct. 12.

Attorney Jeffry Finer, who represents Piotrowski, said the men will be pursuing bail, but are waiting on documents from Poland to “impress the court” which could take over a week.

“Among this group, there are a number of advanced degrees and zero criminal history,” Finer said.

None of the men has a criminal history in the United States, according to prosecutors, but it’s unknown if they have criminal records in Europe.

According to court documents, two women told police they were invited onto the tour bus following the show. The alleged victim of the rape said that, after talking for some time, she went into the bus bathroom where she was “grabbed and spun around to where she was facing the sink and mirror in the bathroom,” and subsequently raped by each of the members of the band.

The other woman told police that she was able to escape after kicking one of the band members in the groin.

Decapitated announced last month that it was canceling all previously announced tour dates. The band also publicly denied all accusations.

In an announcement last week, the Decapitated members stated that the charges against them were pressed “as a procedural formality” adding that “without doing so, the police would be forced to release band. This is not a conviction or any indication of guilt or innocence.”

The musicians added: “Some facts are indisputable at this point – that the original officer who took the complaint from the accuser stated, ‘I do not have probable cause that a rape occurred,’ and it’s taken a full thirty days to file charges, which is right up against the point at which the defendants would legally have had to be released.”

“The band firmly refutes the allegations and are confident that once the facts and evidence have been seen and heard, they will be released and able to return home.”

Agonia Records Signs Thaw For New Album “Grains”

Three years after building a sonic monument with “Earth Ground”, Poland’s experimental black metal band Thaw returns with the brand new full-length album “Grains,” which is scheduled for a December 8th release via Agonia Records.

In the past years, the world of extreme music witnessed a monumental turn in black metal philosophy. A new, experimental approach stormed the genre and while many purists shook their heads in disapproval, a new age was already starting. As with every revolution, there were leaders and followers. While not being there for the initial spark, you can hardly call Thaw the latter. This Polish black/experimental powerhouse was founded in 2010 by members of such acclaimed acts as Mentor, ARRM and Furia. Their music boldly fuses black metal with sludge, doom and sonic experiments, along with with noise, electronics and free-impro.

Recorded during sessions scattered over various periods of time, “Grains” is not just another step forward for the already acclaimed band. The album divided into five pieces evolves in multiple directions. There is Thaw’s trademark take on black metal noise, there is drone, last but not least – there is the ability to conduct a unique narrative with music. Intensity combined with abandoning traditional structures make the new effort of one of the most forward-thinking bands an experience one of a kind. A distorted landscape where creation meets destruction perfectly painted.

“Grains” has been once again recorded and produced by THAW at Maq Records Studio and Satanic Audio. A cover painting made by Furia’s Sars as well as appearances of Maciej Morus (Mitch & Mitch, ex-Starzy Singers) and Stawrogin (Odraza) only add to the album’s mystery and weird magnetism.

Debut EP “Hexing Graves” Announced By Rites Of Daath

Godz Ov War Productions has set October 13th as the international release date for the debut EP from Poland’s Rites of Daath, “Hexing Graves.” The EP is going to premiere during a gig ‘No Reason To Live’ where Rites of Daath will be support Malthusian, Outre and Taran. This release will be available as a standard jewel case CD and Digital Download.

A few words from the band about the concept: “Rites of Daath’s general aim is to create a heavy and crushing sound. It blends massive, slow parts with sudden explosions of sheer madness in the faster parts. The band’s music is deeply rooted within the death metal underground scene, and it’s faithful to the old school and raw sound. It was inspired by a variety of death/doom metal acts, such as Necros Christos, Morgoth, Grave Miasma and Asphyx, as well with Celtic Frost and Hellhammer. Dark and intense, the music is a reflection of the lyrical concept, because the music and the lyrics are an entity, and they focus around various alchemical themes, revolve around death and the cult of it. The EP itself evokes the majesty of death, but not only as a power behind everything,but also as a passage to the absolute. The production is 100% natural, without any triggers or a pumped, artificial computer-like sound.”

“Hexing Graves” was recorded in the damned summer of 2017 at Roslyn Sudio and Michal Pijocha’s Studio, with mixing and mastering at Roslyn Studio. The artwork (shown below) was created by a young Polish artist, Julia Siuda. The logo was created by Ihasan Art.

Bermuda Debuts New Video “Gnashing Teeth” From Latest Album “Nepenthe”

Bermuda debuts a new video entitled “Gnashing Teeth”, taken from the bands latest album “Nepenthe”, which was released June 16th via Urban Yeti Records. Comments the band’s vocalist Corey Bennett of the video:

All Four Members Of Decapitated Accused Of Gang Raping A Girl On Their Tour Bus

Recently released court documents reveal disturbing details in Decapitated’s recent arrest. As reported earlier past week all four members of the band, Michal Lysejko, 27; Waclaw Kieltyka, 35; Rafal Piotrowski, 31; and Hubert Wiecek, 30, were arrested on September 09th after the band’s show in Santa Ana, CA with a potential charge of first degree kidnapping.

The charges stemmed from an incident which took place following the band’s August 31st show at “The Pin” in Spokane, WA. As it turns out, all four band members have now not just been accused of holding a female against her will, but also gang raping her on band’s tour bus, while also sexually assaulting the victim’s friend.

Spokesman.com have provided the following summary of the court documents that were revealed:

“The women said they ended up speaking with members of Decapitated and were invited to have drinks in the tour bus parked outside the venue, according to court documents. One woman “described being excited to be on the bus, and then one of the band members began grabbing her breasts,” court documents say. “He was later identified as the drummer, Michal Lysejko.”

The same woman “was uncomfortable and said the band members began speaking to each other in Polish,” court documents say. “She described the ‘vibe’ in the bus changed, and one of the members began looking at them like they were prey.”

The woman said she looked at her friend “to signal they needed to get out of there.” She then used the bathroom and was followed by the lead singer, Piotrowski, according to court documents. The woman told police Piotrowski began kissing her as she finished using the bathroom, and she began resisting when he started undoing her belt, according to court documents. She said she wanted to leave the bus with her friend, but a band member indicated her friend had already left, saying, “You have to have fun. She left you.”

The woman “attempted to push Piotrowski away but he grabbed her arm and spun her around to where she was facing the sink and mirror in the bathroom,” court documents say. “She saw in the mirror and out of the corner of her eye each of the band members taking turns raping her.”

The friend, meanwhile, said she watched the band members rape the other woman, and Piotrowski asked her to perform oral sex on him. When the friend refused, court documents say, “she was pushed to the ground and received bruises to her knees and shins.”

Shortly after leaving the tour bus and driving away, at 12:43 p.m., the friend was pulled over on North Washington Street near West Boone Avenue on suspicion of driving under the influence, according to court documents.

In the back seat of a patrol car, the friend was allowed to use her cellphone to call the other woman, who reported the rape. A state trooper said he couldn’t help without a specific location and proceeded with his DUI investigation.

The alleged victim “described her body as feeling broken,” court documents say. “After an unknown amount of time,” she told police, “Waclaw (Kieltyka) helped her put her clothing on and carried her out of the bus with another male.”

She walked north from The Pin and called several family members before calling 911, according to court documents. An officer found her near North Post Street and West Buckeye Avenue, about 2 miles from the venue. The officer also stopped by The Pin and “checked the area for the tour bus, but the band had already left Spokane for their next venue.”

The woman was taken to Providence Holy Family Hospital for a sexual assault examination.

Detectives noted she had “significant bruising to her upper arms consistent with being restrained” and “small abrasions to her knuckles that were scabbed over.” During the rape, she said, she “was digging her fist into the wall to try and distract herself from what was happening.”

Court documents say detectives from the Los Angeles County Sheriff’s Office interviewed the band members on Thursday.

Lysejko, the drummer, “made no comment other than he did not know who the girls were” when shown a picture of them. “He said he would not talk without using a translator,” court documents say.

Kieltyka, the lead guitarist, told detectives he saw both Piotrowski and Wiecek engaged in a sex acts with the woman in the bathroom. He agreed to have a DNA swab collected as evidence.

Piotrowski “admitted there was a party on the bus and (the women) were present. He then requested an attorney and a translator refusing to make any further statements,” court documents say. He declined to give a DNA sample.

Wiecek, the bassist, admitted the women had been on the bus, but said he “sat on the couch and did not see what was going on,” court documents say. “He then said he needed a translator so he did not misspeak. He also said no one was forced to get on the bus. He then said he did not recall what happened.”

Wiecek also declined to give a DNA sample.

A fifth man, Wojciech Cichocki, told detectives he was asleep in the cab of the tour bus and never saw the woman who reported being raped. Cichocki said he “only briefly” saw the friend who was later pulled over. “He also made a reference to (her) Instagram account but would not elaborate on it,” court documents say.”

All four members remain in custody in a Los Angeles County jail awaiting extradition to Spokane, WA. The band’s attorney Steve Graham had previously stated: “There is another side to this. We have witnesses that can testify to the fact that the accuser came to visit band of her own free will and left on good terms.”

In light of the most recent accusations now being made public, he commented: “Decapitated plan to fully fight the allegations that are brought against them, and we are fully confident that the other side of this story will be heard.”

He declined to comment further.

Decapitated Arrested In California On Suspicion Of Kidnapping Fan

After releasing the “Anticult” album via Nuclear Blast Records, Polish metal band Decapitated recently hit the road in the U.S. to support the release alongside Thy Art Is Murder.

While the tour is ongoing, Decapitated won’t be appearing on any further dates of the trek, with all four members of the band arrested in California this morning.

The Spokesman Review reported the following:

All four members of the Polish death metal band Decapitated were arrested in Santa Ana, California, early Saturday on suspicion of kidnapping a woman after their concert in Spokane on Aug. 31.

A woman reported to police just before 2 a.m. on Sept. 1 the alleged kidnapping by the band members, said Spokane Police Department spokeswoman Cpl. Teresa Fuller. The band had performed with Thy Art is Murder at The Pin concert venue downtown as part of their “Double Homicide” tour. Fuller said she believes the woman attended the heavy metal concert.

The band members were arrested by the Los Angeles County Sheriff’s Office after their Friday night concert in Santa Ana. They have been identified as 27-year-old Michael M. Lysejko, 35-year-old Waclaw J. Kieltyka, 31-year-old Rafal T. Piotrowski and 30-year-old Hubert E. Wiecek. All are Polish nationals.

The four are in the Los Angeles County Jail awaiting extradition to Spokane. Fuller said additional charges are possible. The case is still under investigation by the department’s Special Victims Unit.

Defense attorney Steve Graham of Spokane said he was hired by the band on Thursday after they became aware of the investigation.

“There is another side to this,” he said. “We have witnesses that can testify to the fact that the accuser came to visit band of her own free will and left on good terms.”

He said he told police that the band members had offered to surrender but never heard anything back. “I made it clear that I could get the guys up here ASAP and they would cooperate,” he said.

Graham said he’s concerned that they will “languish” in the Los Angeles County Jail for weeks before being returned to Spokane, but said the four will not fight extradition and will return to Spokane willingly.

At this point no statement has arrived from the band or label, but it seems a good bet there won’t be any further U.S. appearances on the remaining dates. The band was also scheduled to tour Europe alongside King Parrot in October and November.
